DME/IME FAQs

  •   DME: Defense Medical Evaluation / IME: Independent Medical Evaluation
We use these two terms interchangeably.
  • An IME is used in litigation to confirm the Plaintiff’s injuries are as serious as they claim to be, ensure their physicians provided an accurate assessment of their injuries and treatment, and provide an opinion as to what residuals, if any, should be expected from those injuries moving forward.

The litigation process can be intimidating to claimants, especially when they have to see a doctor they are not familiar with, who is looking for any reason to mitigate their claims and injuries. Our TTS advocates prep your clients for exam day. They explain to them what to expect and prepare them for the exam, so they are focused on explaining their injuries, symptoms, and lifestyle changes, rather than the exam itself. Still not sure if you should send TTS with your client? Check out the article below for circumstances that warrant DME Attendance. https://ttsdevsites.wpengine.com/wp-admin/post.php?post=2032&action=elementor#

  • Most of the time these physicians are hired by the insurance company that requests the IME. Other times they can be designated by the courts.
  • Total Trial Solutions will take notes on all questions asked, answers given, tests administered, and most importantly, the overall timing of the exam. In addition, our experienced advocates will include a personal observation section in each report detailing both the doctor’s and client’s demeanor, the conditions of the exam location, as well as any complaints and/or limitations displayed by your client prior to, during, or after each exam.
  • Yes! Upon your request and the IME doctor’s approval, our client advocates can record your client’s examination using high-quality audio and video recording technology. Please let us know as soon as possible if you would like to record the exam so we can make the appropriate arrangements with the defense attorney and doctor.
  • Unlike our competitors, Total Trial Solutions will review your client’s medical records and case file prior to the date of the exam, so that we can be most informed for your client. Ultimately, your client will be more than a file number to us, and we tailor our approach to their needs and injuries. Don’t send someone who doesn’t know your client’s story!
  • Our attorney-privileged reports can be used during depositions, settlement conferences, and trials to refute conflicting statements made by the insurance companies and their hired guns. Because these observational reports are privileged, the defense and doctor will never see it coming!
  • The opinions of an IME doctor will be used by the insurance company to assess the value of your client’s injuries.
